Terms of Service

1. Acceptance of Terms

By accessing or using the Jochi platform (the "Service"), operated by Jochi Labs, Inc. ("Jochi," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service. Your continued use after such changes constitutes acceptance.

2. Description of Service

Jochi is a free, anonymous platform for Applied Behavior Analysis (ABA) professionals that provides pay transparency data and compensation benchmarks by role, location, and experience; anonymous clinic ratings and workplace reviews; job discovery for ABA professionals; and personalized pay comparison reports.

The Service is free for individual ABA professionals (therapists, RBTs, BCBAs, BCaBAs) and will remain free for individual use.

3. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you are at least 18 years of age and that the information you provide is accurate.

4. Accounts and Authentication

Some features require a free account. You may create an account using Google Sign-In or a magic link sent to your email address. We do not use passwords.

You are responsible for maintaining the security of your email account and for all activities that occur under your Jochi account. You agree to notify us immediately of any unauthorized use.

5. User Content and Conduct

You may submit pay data, clinic reviews, and other information ("User Content"). By submitting User Content, you grant Jochi a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content in connection with the Service, including in aggregate and anonymized form. You retain ownership of your User Content but acknowledge that reviews and pay data are displayed anonymously and cannot be attributed to you by other users.

Your User Content must not contain Protected Health Information (PHI), personally identifiable information about colleagues or supervisors by name, false or fraudulent information (including fabricated pay data), defamatory or harassing language, content that violates the BACB Ethics Code or any applicable law, or spam and promotional content.

We reserve the right to review, approve, edit, or remove any User Content that violates these standards. We may suspend or terminate accounts that repeatedly violate content policies.

6. Anonymity and Privacy

Your reviews and pay submissions are displayed anonymously. We do not reveal your identity to other users, clinics, or employers. However, we may be required to disclose information in response to a valid legal process (see Privacy Policy for details).

We will never sell your individual data to clinics, employers, or third parties. Aggregate, anonymized data may be used for platform features and, in the future, employer-facing products.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee the accuracy, completeness, or reliability of any pay data, clinic ratings, or job listings on the platform.

Pay data is crowdsourced and may include estimates derived from public sources. It should not be relied upon as the sole basis for employment or compensation decisions. We are not a financial advisor, employment agency, or legal counsel.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOCHI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed $100.

9. Intellectual Property

The Jochi name, logo, brand assets, and platform design are the property of Jochi Labs, Inc. You may not copy, modify, or distribute our proprietary materials without written permission.

Aggregate data displays, comparison algorithms, and report formats are proprietary to Jochi. Scraping, automated data extraction, or systematic downloading of data from the Service is prohibited.

10. Clinic and Employer Accounts

In the future, clinics and employers may be able to claim their profiles, respond to reviews, and post job listings for a fee. Additional terms will apply to those accounts. Clinics will never be able to identify individual reviewers.

11. Termination

You may delete your account at any time. We may suspend or terminate your account for violation of these Terms or for any other reason with reasonable notice. Upon termination, your account data will be deleted, but anonymized reviews and pay data you submitted will remain on the platform.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Los Angeles County, California, unless you are entitled to bring claims in small claims court.

You agree to waive your right to participate in class action lawsuits or class-wide arbitration against Jochi.
